Agreement
These terms and conditions ("Agreement") set forth the general terms and conditions of your use of the writefol.io website ("Website" or "Service") and any of its related products and services (collectively, "Services"). This Agreement is legally binding between you ("User", "you" or "your") and this Website operator ("Operator", "we", "us" or "our").
By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Website and Services.
Accounts and membership
You must be at least 18 years of age to use the Website and Services. By using the Website and Services and by agreeing to this Agreement you warrant and represent that you are at least 18 years of age. If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.
We may monitor and review new accounts before you may sign in and start using the Services. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
Credit allocation and use
You will receive a specific allotment of monthly credits in accordance with the tier of your chosen subscription plan. Credits will be added to your account each month on the Credit Renewal Date, which falls on the same date each month as your original subscription date, adjusted for shorter months.
- Credits are intended for the utilization of services and features offered within the scope of your subscription.
- Credits have no cash value and are non-transferable.
- Monthly credits remaining unused as of your Credit Renewal Date will expire and will no longer be available for use.
- If you are subscribed to a plan featuring a credit rollover provision, you will be entitled to retain unused credits as long as you are an active subscriber. Such credits will be eligible for use for a period not exceeding twelve (12) months from their initial date of issuance.
- Purchased additional credits will be exempt from expiration and will remain available until fully expended.
Referrals and promotional credits
Some links to writefolio carry a referral code from a member of our affiliate program. If you sign up after following one of these links, we record which affiliate referred you so that we can pay them a commission on your subscription. This does not change what you pay — prices are the same however you arrive.
Referred accounts may receive bonus credits as a welcome. Bonus and promotional credits work like all other credits: they have no cash value, are non-transferable, and follow the credit lifecycle described above.
We may reverse promotional credits, remove a referral record, or both where they were obtained through fraud or abuse — for example, self-referral schemes or automated signups. Affiliates themselves are bound by a separate Affiliate Program Agreement, which governs how they may promote writefolio; it binds affiliates, not referred users.
Refunds and cancellation
Your subscription to the Website and Services will renew automatically each month. You may cancel your subscription at any time from the account membership page or by emailing us. Due to the nature of digital services, we do not refund fees on cancellation.
If you downgrade to a lower tier plan, you will retain access to your previous plan until your renewal date. If you upgrade to a higher tier plan, you will receive a pro-rated refund of unused time on your previous plan when you are charged for your new plan.
Prohibited uses
In addition to other terms as set forth in the Agreement, you are prohibited from using the Website and Services or Content:
- (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
- (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
- (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
- (f) to create sexually explicit content featuring minors or content that sexually exploits minors;
- (g) to submit or create false or misleading information;
- (h) to upload or transmit viruses or any other type of malicious code;
- (i) to spam, phish, pharm, pretext, spider, crawl, or scrape;
- (j) to create content that is political in nature.
Your content
We do not claim ownership of any text or images that you create, store, or share through the Website and Services ("Your Content"). All rights in and to Your Content remain with you.
By using the Website and Services, you represent and warrant that you have all necessary rights to upload and share Your Content and that doing so does not infringe any laws or the rights of any third parties. When you upload or transmit Your Content, you grant us a non-exclusive, royalty-free, worldwide license to host, store, process, display, and transmit Your Content, but solely as necessary to provide and improve the Website and Services.
Limitation of liability
To the fullest extent permitted by applicable law, in no event will the Operator, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability.
The aggregate liability of the Operator and its affiliates relating to the Services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to the Operator for the prior one month period prior to the first event or occurrence giving rise to such liability.
Dispute resolution
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of California, United States without regard to its rules on conflicts or choice of law. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in California, United States, and you hereby submit to the personal jurisdiction of such courts.
